Terms & Conditions
These Terms & Conditions outline the rules and guidelines for using my photography services. By booking a photoshoot, you agree to the terms set forth here. These conditions help ensure a smooth and positive experience for both of us and clarify expectations related to bookings, payments, cancellations, and other essential aspects of our agreement. Please read these terms carefully before proceeding, and don’t hesitate to contact me if you have any questions or need further clarification.
Booking and Payment
  • Clients are required to review the complete Terms and Conditions and Privacy Policy, which are available on my website, before proceeding with a booking, deposit, or payment.
  • You can select and secure a date and time using the form in the online calendar on my website or directly via the link. In the booking form, checkboxes must be selected to confirm that the client has read and agreed to the Terms and Conditions and Privacy Policy. By ticking these boxes, you acknowledge that you have read, understood, and accepted the stated policies.
  • After choosing your preferred time slot using the online calendar, you must send a 50% deposit via e-transfer to tche.noir@gmail.com within 24 hours to confirm your reservation. Your spot will be secured only after the payment is received.
  • The remaining payment must be settled immediately after the photoshoot. Accepted payment methods include e-transfer or cash unless otherwise agreed beforehand.
Rescheduling and Cancellation for Photoshoots
  • If you have decided to reschedule or cancel your session, please notify me as soon as possible to allow for necessary adjustments.
  • The deposit is non-refundable as it secures your date and time, partially compensates for preparation efforts, and accounts for missed opportunities to accept other bookings for that time slot. Once I receive your deposit, I reserve the specified time exclusively for your session, making it unavailable to other clients. However, I aim to offer flexible solutions so your deposit doesn’t go to waste. Within three months of the original session date, you have the following options:
  1. Reschedule: Transfer the deposit to a new date if you plan to reschedule the event.
  2. Alternative Use: If the event won’t take place, you can apply the deposit toward a different type of photoshoot or service of equivalent value.
  • If I cancel the session for valid reasons, the deposit will be refunded to the client. I am not responsible for any financial losses related to these circumstances..
Photoshoot Terms and Details
  • It is important to arrive on time for your session. Delays caused by the client may result in a shorter session or require rescheduling, depending on the photographer’s decision.
  • The photoshoot's location, duration, special client requests, and other key details will be confirmed prior to the session.
  • Any special requests regarding outfits, locations, poses, large groups of people, or creative ideas should be communicated in advance or during the session itself, as long as these requests are feasible and do not require the cancellation or rescheduling of the photoshoot.
  • If you wish to extend the session, additional time can be added for an extra charge, depending on the photographer's availability and schedule.
Image Delivery Process
  • I will carefully choose the best images from the session and upload the original files to a dedicated gallery platform for your review. From these, you can select a specified number of photos for editing, as agreed upon in the chosen package. All images must be downloaded within 3 months, as they will be removed from the gallery after this time.
  • The edited photos will be made available within 1-3 weeks following the session, delivered via the dedicated platform that hosts your personal gallery. Delivery times may vary based on the selected package.
  • I reserve the right to select which images will be edited and provided to you.
Copyright
  • All images taken during the photoshoot are the exclusive property of the photographer and are protected by copyright law. The photographer retains all rights to the images, including, but not limited to, the right to use, reproduce, and distribute the photographs.
  • Upon payment, the client receives a limited, non-transferable license to use the edited images for personal, non-commercial purposes only. This includes printing the images for personal use, sharing them on social media, and displaying them in personal albums. The client may not use the images for commercial purposes without prior written consent from the photographer.
  • If the client shares images on social media, they must provide credit to the photographer by tagging the photographer’s social media account or using the photographer’s business name, as appropriate. Failure to provide proper credit may result in the photographer revoking the client’s usage rights.
  • The client is prohibited from altering or editing the photographs in any way, including applying filters, cropping, or changing the color or composition of the image. If the client wishes to make changes to the images, they must request permission from the photographer in advance.
  • The client may not distribute, sell, or publish the original or edited images without the explicit written permission of the photographer. This includes using the images for commercial purposes, such as advertising, promotion, or resale.
  • The photographer may add a copyright notice or watermark to the images to assert their copyright ownership. Clients are not authorized to remove or alter any watermark, logo, or copyright notice added by the photographer.
  • The photographer retains the right to use the images in their portfolio, website, social media, and marketing materials, unless otherwise specified by the client in writing at the time of booking or during the session. If the client requests that specific images not be used for promotional purposes, they must inform the photographer in writing. The photographer will make reasonable efforts to comply with such requests.
  • The license granted to the client for personal use does not transfer any copyright or ownership rights to the client. The photographer retains full copyright ownership of all images.
  • The client has the right to request that the photographer removes specific images from public platforms (such as the photographer’s website or social media). The photographer will make reasonable efforts to comply with such requests, provided that it is technically feasible and does not conflict with any previously made agreements.
Image Usage and Client Consent
  • By booking a photoshoot, the client agrees that the images taken during the session may be used by the photographer in their portfolio, website, social media accounts, and other promotional materials unless otherwise specified by the client.
  • All photographs will be handled and used in compliance with the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable privacy laws. The photographer agrees not to disclose the client’s personal data without explicit consent, except where required by law.
  • The photographer retains the right to use the images for personal, non-commercial purposes, including posting them on online portfolios, social media accounts, and in promotional materials.
  • The client has the right to request that specific images not be used for promotional purposes. If the client wishes to revoke consent after the photoshoot, they must notify the photographer in writing. Upon receipt of such a request, the photographer will make reasonable efforts to remove or refrain from using the requested images in the future.
  • All images published or posted by the photographer will be accompanied by the photographer's name or business name unless otherwise agreed upon by both parties.
  • If the client requests the removal of images from the photographer’s website or social media accounts, they must notify the photographer within a reasonable time frame. The photographer will remove the images if technically feasible and if it does not affect any previously made agreements or publications.
  • The client understands that withdrawing consent does not affect the validity of previously granted rights to use images before the request for removal.
  • The photographer agrees not to use the images for any purposes that could negatively impact the client’s reputation or honor and will respect the client’s rights.
Editing and Retouching Services
  • Standard photo editing and retouching, including adjustments for color, exposure, and minor skin smoothing, are included as part of the package you selected.
  • Any additional editing requests beyond the standard services, such as extensive skin retouching or removal of objects, will incur an extra charge.
Refunds After Photo Editing
  • Refunds are not provided for completed sessions, except in cases where there was a significant issue with the service provided.
  • If you are dissatisfied with the results, I offer one round of revisions to the edited photos to ensure they meet your expectations.
Liability
  • I am not responsible for any loss or damage to the client’s personal property during the photoshoot.
  • I am not liable for unforeseen circumstances that may affect the quality or completion of the session (such as equipment failure or weather conditions). In such cases, I will do my best to reschedule or offer alternative solutions.
  • I am not responsible for any damage to the property of the studio, location, or third-party organizations (including, but not limited to, furniture, equipment, and other items) if the damage was caused by the client’s actions or negligence.
Conduct and Behavior
  • My goal is to maintain a respectful, professional, and comfortable environment throughout the session. Any inappropriate behavior from the client, or myself, will lead to the immediate termination of the session without a refund.
  • I reserve the right to decline any session or project that involves illegal, unethical, or inappropriate content.
Additional Expenses
  • Any additional expenses that may arise during the photoshoot, such as travel costs, extra services, or specific materials, will be discussed and agreed upon with the client in advance, prior to the start of the session.
  • The cost of any additional services or changes to the package will be agreed upon before the photoshoot begins to avoid misunderstandings.
  • For photoshoots held outside the city or in remote locations, the client is responsible for covering all travel costs associated with the photographer and the team (if applicable). This includes expenses such as fuel, transportation tickets, accommodation, and meals for the duration of the shoot.
  • In certain cases, if unforeseen expenses arise during the session (e.g., for additional services or materials), these expenses will be discussed with the client and must be paid before the session concludes.
